What is Domestic Abuse?
According to Minnesota law, domestic abuse meets at least one of the following conditions:
- A family member causing fear or physical harm to another family member; or

Minnesota’s Domestic Abuse Act
The Minnesota Domestic Abuse Act was created to help victims seek relief and safety from abusive family members. Under this law, the victim can obtain an Order for Protection (OFP), making it illegal for the abuser to come within a certain range of the victim. An OFP can be made on behalf of a minor. The court may also order a temporary OFP if there is a chance of immediate danger.
What Happens when an Order for Protection is Violated?
Violating an OFP is a crime. The violator can receive up to 90 days in jail, a $1,000 fine or both. The violator may be arrested by police and taken to jail. Violating the order is also contempt of court which could mean stiffer punishments. For repeat violators, the act becomes a felony and the violator can go to prison long-term and face higher fines.
